    Lose the power of speech from the first interaction. I won't even answer the Miranda question. On that occasion I was given a citation with my name, address and ID # written from officer's memory. So, yeah, that whole "targeted individual" thing is also true.

    You're not an officer not having probable cause yet engaging in an unlawful search and seizure, such as anything I say in order to use it against me, are you? Your best bet is to prove-up there wasn't probable cause. You can't ever make an incriminating statement: There is never probable cause to assert such as a metaphysical truth. The 1st Amendment exists as circumstantial evidence in combination with the need for due process to show such as true, besides involving (1) the problem of the criterion, (2) the rule-following paradox, and (3) and rules of inference in asserting such. Remaining silent doesn't necessarily work well, but exists as part of free speech. The idea is that a defendant talking is irrelevant. What is relevant is defense asking questions to prove-up that there was not probable cause. Motion to dismiss because the one or more necessary and/or sufficient conditions required to be fulfilled have been fulfilled.

    I have a cousin who is a seasoned police detective. We used to see each other in football games, barbeques etc But he's no longer invited because he always assumed the worst in everyone 😂😂😂😂😂😂😂😂😂😂

    Interesting to hear the point that cops take the view that they are on the prosecution team, working for convictions. Yet even with that attitude, nationwide the average American cop does about 7.5 arrests annually. American policing is astoundingly ineffective.

    Can you stay silent ALL of the way through until you get to a lawyer? Such as even when you are being booked at a jail? What happens if it takes several days to finally get a lawyer?? can they keep you locked up in jail? If so, if you are being kept in jail can you still stay silent? Can they make you talk to a judge without a lawyer?

      No. You have the right to never say anything. And remember this. The longer they keep you in jail while you are waiting for court... The more its going to cost them and it will be taken into your case as well. You have a loss of work, loss of income etc... Its all a game. Your not going to win by being tougher. Youre going to win by being smarter and knowing the game.

    You have to use common sense or you will create more problems than you prevent. For example, if you pass through a road block in my state where they are stopping every car they are usually looking for felonies or DUIs. They are not much interested in much else. The more cars they have to deal with the more this is the case. If you start refusing to answer their routine "Where are you coming from" etc questions you are going to draw attention and get more scrutiny than you otherwise will and everything about you and the car and its paperwork better be clean because if not they're going to do their best to find it and write it up. I have skated on numerous violations over the years that would have been thousands in tickets that a little more diligence would have found just by blending in with everybody else and as a result police not thinking there is anything about me or the car worth the extra time and trouble of further investigation. Now if they show up at your front door then obviously they already suspect you of something and thats different but if you're going to refuse to answer their routine questions in routine situations you're going to get cited on things you can't beat in court and pay a lot more fines than you otherwise will. They also might decide you're interesting enough to call for the drug dog while they write a ticket and find that kilo of heroin. Its a fine line but in general refusing to answer questions so routine that you make yourself stand out can draw attention you otherwise wouldn't get and may not want.

    Are folks who live in Red states or regions experiencing this same adversarial relationship with prosecutions? I live in Portland OR, so I know NEVER to say anything. Our district attorney Mike Schmidt is absolutely against law abiders.

    My neighborhood used to be really bad. It was because of a few bad apples not the whole community. Don’t snitch was just part of the culture. Some of my neighbors and I had enough and started talking to the police about it. When the police had cooperation the could actually do their job. Crime went down once people stopped just getting away with it. It didn’t totally fix things. I know going to prison doesn’t “help” those who get arrested. But I don’t want to help them. I want to help the decent folk in my community. Talking to the police helps.

    Sir, I've been watching shows like Forensic Files, 48 hours, and others like it for over two decades now. Longer still if I include Mannix, Barnaby Jones, and more from that era. These days it's trials. Johnny Depp V. Amber Heard, Alex Murdoch and other less knowns. But in all that time I have never seen anyone explain something I consider to be so important, so simply and clearly. And all in just 13 minutes. I'll be sharing this with my kids, my family, and friends. I sincerely thank you sir.

    I have some friends who are police in various states. So I speak to them on occasion. But I have learned to be cautious on what you say when it comes to some investigation. I'm a boring person LOL! So really haven't been in some sort of interrogation. But know if I ever was, I would be contacting a lawyer for help. Because I don't trust our court system. It's a joke. And we the people are it's brunt.

    I disagree with Craig Atkinson on a couple of points 3:20. There is no presumption of innocence, quite the contrary! Furthermore, there is no requirement for the prosecution to prove their case. They can simply present some damaging evidence and hope that the decider(s) feel that the defendant is guilty by whatever process they choose.

    Sound advice & very correct assessment of how police view their role! 2 childhood friends who became cops dramatically changed after joining the force to the point that we don’t even hang out anymore. I can’t say if they became jaded from the job or were influenced by police culture, or both but they changed significantly. I’m not sure if they’re actual racists, but they became very comfortable with extremely racist language & also with violence. They would relay stories about work when they got to beat someone up & described what a rush it was & how fun it was to stomp someone, etc. We do need police, but they are NOT your friend.

    Ok right there the whole adversarial system explains so much that I've been trying to put into words that's the whole problem just like with people in general most people equally or even sometimes more so especially when angry or hurt or both want to see someone take the blame and be punished just as bad as saving the innocent they want to see someone convicted for life or executed rather by lethal injection or frying like a peice of bacon riding the lightning in old sparky electric chair even though it wont bring back the victim we all know that convictions should be primarily about protecting other innocent potential victims like with murderers or rapists especially pedophiles but usually it's this self righteous entitlement to justice everyone has and the need primal need to see someone punished like when people did public hangings in the past it's not enough for the execution to take place or for it to at least be done discreetly in good taste but for everyone and there dog to see it and praise and cheer on the event its sick and barbaric in my opinion and with cops there are basically programmed to look for trouble to sniff out criminals and perpetrators like a drug sniffing dog they don't walk into a situation with a open mind try to find evidence and follow the evidence wherever it leads they cherry pick are bias even prejudice lead the evidence wherever they want it to go even go as far as to plant evidence to support there claims of conviction into a huge conspiracy theory thinker but I certainly do believe in greed and corruption and think there's more bad police than people realize also that they do more shady immoral stuff than people realize for example "civil Asset forfeiture" for those who dont know look it up on RUclips there's some good juicy videos on it and it's a embarrassing joke for our country and constitution basically it's a grey area where if someone has a large some of cash on hand a police officer can just take it without probable cause without a search warrant or even permission to search and seger they can just use there own moral judgement which is never about morality when it comes to that it was set up along time ago to take down the big fish drug dealers and drug lords and such basically the Walter white tony soprano and Tony Montana aka scarface of the criminal drug world and people believe it was beneficial for a long while but that's naive at best even if it was even for a little while it's certainly not now and hasn't been for a long time it's primarily targeting normal average good citizens like this one guy who was driving to another state to buy a pickup truck that he really wanted and the man who was selling it unfortunately only would take cash and he had to physically go buy it and pick it up was a victim with absolutely zero probable cause or evidence of any kind that the money was obtained illegally in fact also in ome documentary a few police are ashamed feel guilty and decide to just open up and be honest about it and say they do it excessively all the time that there traffic cops are actually trained and not just encouraged but even required to seize a certain amount of cash to fill a quota much like writing enough speeding tickets one cop said that the money was used to pay his Bill's for like a whole year on top of him saving much of his regular pay and the most ridiculous thing was they bought a margarita machine to make drinks from other people's cash so uncivilized and unnecessary its disturbing disgusting and despicable frankly dowm right embarrassing more people need to understand police are not like soldiers these valiant honorable heroes like marshals in the old wild west where they are peace keepers and such there now more so just literally law enforcement they exist to keep order and go out and get the bad guys or criminals more accurately those who can be targeted and blamed for crimes not just primarily bad guys many people are victims to cops esp minorities which is very wrong when they say whatever you say can and will be used against you it means just that even if you have something to say that can actually help you others or even the police themselves to actually catch the real bad guy or even help a victim it's literally cant help you only be used against you there's another time and place to offer that kind of information let's say you new for a fact where some little girl was being held ransom by a kidnapper also even if you were a victim as well say who was assaulted or even escaped from the kidnappers but you new where the other victim was being held it could even be your little sister or daughter even where it's very clear to everyone that you didn't do it are even a victim yourself theres always a way that can be spun against you to convict you as crazy as that sounds it sucks that the legal system isn't much better than it is what's scary is the truth isn't always what's most important to people many people stand trial for murders that were complete accidents that weren't even there fault but at the end of the day you present your story they present there's and a group of jurs and one judge decides whose telling the truth and they all decide your fate it's not always just entirely up to the judge and the facts aren't always what's in the for front of focus often ots about rhetoric and emotional manipulation many people don't even understand what the burden of proof means like if you were in a fight with your girlfriend and she grabbed a crowbar and was trying to hit you with it and you dogged it once then she came at you again you grab the crow bar and in the struggle you hit her head and she slips on the snow and her face falls straight first on the car tire jack and she's dead (the exact scenario in the movie before and after) amd the prosecutor asks well how are you supposed to prove to us that you weren't just angry at her and hit her across the head? That's the fifth amendment of not being obligated to self incriminate and the burden of proof at play your not required to ask that question the person making the accusation against you or a claim in general like ghosts or god is the person required to provide the evidence and accusations of something as serious as murder are very extraordinary claims much like belief in god and there's the saying extraordinary claims require extraordinary evidence bad people will always be out there and will always eventually kill from time to time as well as accidents will always inevitable happen where chaos and tragedy will ensue people will inevitably and unavoidably die for a fact and yes whe should always do our best to protect ourselves especially the innocent women and children from evil bit there must justice should only be served out upon the highest of standards supported by the strongest objective facts and evidence so innocent people don't suffer false convictions and create unnecessary unwarranted suffering on top of the ones we already have because of we use our brains embrace our intelligence that is one area we can control is who we convict condemn and punish just the same as controlling our impulses and actions also exercising what's morally right along with taking responsibility for our actions as we can always choose to do what's right and tell the truth it should be as just and simple as the truth will set us free but the law is a giant reckinball of a circle that not only can be spun any which way to interpret the truth from any which perspective making truth merky and often in the eyes of the beholder instead of justice being blind and supported only by the facts but that reckinball is also guaranteed to come smashing down on someone like plowing down an old house it's sad that justice often gets blurred with revenge people think there the same justice is about protecting the innocent the weak the vulnerable and removing the threat more than just punishing the guilty justice is about harmony revenge is just about making yourself feel better they absolutely are never one and the same
